Terms of use for subscribers
Notice regarding the language priority of the web terms.
In the event of any inconsistencies, contradictions or errors in translation between the English and Czech versions of our web terms, the Czech version shall be the primary and final terms. Czech conditions take precedence and will always apply over English conditions. BY USING OUR WEBSITE AS A SUBSCRIBER OF PREMIUM CONTENT ('Subscriber'), YOU AGREE TO BE BOUND BY THESE TERMS - PLEASE READ THEM CAREFULLY
1. Introduction: These Premium Content Subscriber Terms of Use are additional terms that apply when you use EroticPlanet as a Subscriber. These Customer Terms of Use form part of your agreement with us. 2. The following terms will also apply to your use of EroticPlanet as a subscriber and you agree to them:
a) Our terms of use for all users;
b) Our privacy policy - which tells you how we use your personal data and other information we collect about you;
c) Our rules of conduct - which tell you what you can and can't do on EroticPlanet;
d) Standard Subscriber/Creator Agreement - which is not part of your contract with us, but which governs and sets out the terms applicable to each Subscriber/Creator transaction you enter into on EroticPlanet.
3. The following additional terms may apply to your use of EroticPlanet:a) If you are also a Premium Content Creator, your use of EroticPlanet as a Creator will be subject to the Terms of Use for Creators;
b) If you participate in the EroticPlanet Referral Program, your use of the EroticPlanet Referral Program will be subject to the Referral Program Terms.
4. Your obligations to us: You warrant (meaning you make a legally enforceable promise) that:a) you are at least 18 years old;
b) if the laws of the country or state/province where you live state that you can only be legally bound by a contract if you are over the age of 18, then you are old enough to be legally bound by the laws of the country or state/ the province where you live;
c) you provide us with such information or verification records as we request.
d) the laws of the country or state/province in which you are located permit you to connect to EroticPlanet and view any content available on it and permit you to use any feature provided by it; and
e) you are able and willing to pay (if necessary) to view the content available on EroticPlanet that you wish to view and to use any feature provided by EroticPlanet that you wish to use.
5. Content - The following terms apply to Content posted, displayed, uploaded by you as a Subscriber to EroticPlanet:a) You warrant (meaning you make a legally enforceable promise to us) that for each item of Content you post, display, upload or publish on EroticPlanet:
I. content is fully compliant with the Terms of Service (and in particular with our Rules of Conduct
II. you either own your Content (and all intellectual property rights thereto) or have a valid license to your Content; and III. if your content includes or uses any third party material, you have secured all rights, licenses, written consents and releases necessary for the use of such third party property in your content and for the subsequent use and exploitation of such content on EroticPlanet.b) You agree to be liable to us and to indemnify us if any of the warranties are untrue. This means that you will be responsible for any loss or damage we suffer as a result of false warranties.
c) We are not responsible for and do not endorse any aspect of any content posted by you or any other Eroticplanet user. We have no obligation to monitor any content and have no direct control over what your content may contain.
6. Adult Material: You acknowledge that you are aware that the content on Eroticplanet contains adult material and you agree to take this into account when deciding where to access and view the content. We will not be liable to you if you suffer any loss or damage as a result of your accessing or viewing content containing adult material in a way that puts you in breach of any contract you have with a third party (such as your employment contract). ) or in violation of any applicable law. 7. Subscriber Subscriptions and Purchases: This section describes the terms that apply to Subscriber/Creator transactions:a) All subscriber/creator transactions are a contract between subscribers and creators based on conditions of the contract between the subscriber and the creator. Although we facilitate subscriber/creator transactions by providing the EroticPlanet platform and hosting content, we are not a party to the standard Subscriber/Creator Agreement or any other agreement that may exist between Subscriber and Creator, and we are not responsible for any Subscriber/Creator.
b) Creators are solely responsible for establishing valid pricing (within EroticPlanet's pricing parameters) for Subscriber/Creator transactions and content to which you may be granted access. All prices are listed in CZK or EUR only. If you select the Czech Republic when registering your account, the currency will be CZK. If you select one of the other countries, the currency will be EUR.
c) Payments to customers and their prices are final.
d) In order to enter into a Subscriber/Creator transaction with a specific Creator, you must first have sufficient cash credit in your wallet and then click the "pay" or "repay" button on the wall or profile of the relevant Creator.
e) You authorize us to provide your payment card details to the payment provider Pays, Google or Apple as the payment gateway you have selected for payment, in order to process your payment. All customer payments will be charged in CZK or EUR. (If you select the Czech Republic when registering your account, the currency will be CZK. If you select one of the other countries, the currency will be EUR). Your credit card provider may charge you currency conversion fees. We have no control over exchange rates or fees charged by your payment card provider or bank and are not responsible for paying any fees or charges imposed by your payment card provider or bank.
f) The payment provider will not deduct periodic payments from your payment card for payments to customers. This is not an automatic subscription.
g) You agree not to make unauthorized refund requests in connection with any Subscriber/Creator transaction. We have the right to suspend or delete your user account if we believe that you have made any refund request or chargeback request in bad faith.
h) Wallet Credits: You can subscribe to EroticPlanet with an amount (known as "Wallet Credit") that you can use to make payments later. Credits to the Wallet are subject to a maximum amount set by us from time to time. Interest will not accrue on Wallet credits.
8. Suspension of your User Account: If we suspend your User Account in accordance with our rights under the Terms and Conditions, then all payments by Subscribers will be suspended during the period of suspension of your User Account.
